1. Who we are

MyOpenHouseTour ("the Service") is operated by Vanessa Kwan ("the Seller", "we", "us"), based in Walnut Creek, California, United States. When you create an account or purchase a subscription, you are contracting with the Seller. By continuing to use the Service you agree to these terms. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization, and that you are of legal age to form a binding contract.

2. The Service

MyOpenHouseTour helps you plan multi-stop driving routes for real-estate open houses, including time-window scheduling, saved routes, favorites, and private photos on paid plans. Route times are estimates provided for planning purposes only; always verify open-house times and driving conditions yourself.

3. Acceptable use

You must not misuse the Service. This includes, without limitation:

  • using the Service for any unlawful purpose;
  • fraud, spam, or deceptive conduct;
  • infringing the intellectual-property rights of others;
  • interfering with the security or operation of the Service, including introducing malware, probing or scanning for vulnerabilities, or scraping the Service at scale;
  • reverse engineering, reselling, redistributing, or circumventing technical limits of the Service.

4. Your account and content

You must keep your account credentials confidential and are responsible for all activity under your account. You must provide accurate information and keep it updated. You retain ownership of content you upload (such as photos and notes); you grant us a limited license to host and process that content solely to provide the Service.

5. Intellectual property

We retain all ownership of the Service and its intellectual property, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of your selected plan.

6. Payments and subscriptions

Paid plans are billed monthly or yearly and renew automatically until cancelled. For payment, billing, tax, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Service level

We do not guarantee that the Service will be uninterrupted or error-free. The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your account data may be deleted after a reasonable retention period; you may request an export beforehand by contacting us.

9. Liability

To the fullest extent permitted by law, our aggregate liability to you is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

10. Indemnity

You agree to indemnify us against claims arising from content you upload, your unlawful use of the Service, or your violation of these terms.

11. General

These terms are governed by the laws of the State of California, United States, and disputes will be resolved in the courts located in Contra Costa County, California. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays or failures caused by events beyond our reasonable control. We may update these terms from time to time; continued use of the Service after changes take effect constitutes acceptance.
